Liability for Measurements and Descriptions

Measurements and descriptions provided in any materials made available by any of Genuit Group plc’s subsidiaries, affiliates or associates (collectively “Genuit”, individually “member of the Genuit Group”) from time to time (including, but not limited to, in brochures, websites, catalogues, proposals and quotations) together with any advice or recommendations provided by its colleagues (whether orally or in writing) are provided in good faith but are approximate or illustrative only and are intended to provide a general description of the main characteristics of the products or services in question. Such measurements, descriptions, advice and recommendations may be amended or withdrawn by the relevant member of the Genuit Group at any time and from time to time without notice.

Unless specifically agreed otherwise by Genuit in a written agreement signed by an authorised representative of Genuit, Genuit makes no representation, warranty or guarantee as to the accuracy and completeness of any measurements, descriptions, advice and recommendations as referred to above and, save as otherwise provided for below, shall have no liability to any person for any loss or damage which they may suffer as a result of placing any reliance on the same. The user should consult professionals with appropriate expertise to provide comprehensive information prior to the installation of any product belonging to a member of the Genuit Group.

Prior to purchase, customers must assure themselves that any products or services which they intend to purchase from Genuit are safe and suitable for the purpose for which the customer intends to use those products and systems and are appropriate for the site conditions in question. Final determination of the suitability of any information or material for the use contemplated and the manner of use is the sole responsibility of the user and the user must assume all risk and liability in connection therewith.

Genuit does not seek to limit or exclude in any way its liability for:

(1) death or personal injury caused by its negligence;

(2) fraud or fraudulent misrepresentation; and

(3) any liability which cannot lawfully be limited or excluded (including, but not limited to, liability which cannot be lawfully limited or excluded under the terms of any legislation applicable to the sale of products and services by members of the Genuit Group).

Each of the above exclusions shall be read as subject to this proviso and none of the above exclusions shall be interpreted as seeking to limit or exclude the liability of Genuit for any of the matters as referred to in this paragraph.

Completion of Contracts by Email

Whist operational communications may be made with a member of the Genuit Group via email, Genuit does not as a matter of routine enter into or conclude contracts via email and, contracts may only be formally entered into or concluded by a member of Genuit via email if the message in question is sent by an individual within Genuit with authority to enter into the contract in question and is specifically stated in its text to constitute the entering into or conclusion of the contract in question on the behalf of the applicable member of the Genuit Group.

Service of Notice by Email

Whilst day to day communications may be sent and received by Genuit via email, Genuit does not accept service of formal legal notices via email, unless expressly agreed in the relevant service contract. Any such notices should be addressed in writing to the Company Secretary of Genuit at the following address:
